Accounts, published work, products & sales

Terms & Conditions

Version 0.9-draft, October 20, 2026. By creating an account, acquiring a product, or otherwise using Maru, you agree to these terms. If you do not agree, do not use the service.

Draft: pending legal review

Draft. Pending legal review. These documents were written by the team that runs the service and have not been reviewed by a lawyer. They describe what the product actually does today, and they are the terms we will operate under, but they may change materially once counsel has read them.

Version 0.9-draft · October 20, 2026

1. Who we are and what Maru is

Maru, based in Canada (“we”, “us”, the “operator”), provides the service. These terms cover everything we offer under the Maru name, now or in the future, on any website, domain, app or device (together, the “Service”). Today that includes:

  • the website, your account, your profile and the community, where people publish, play, embed and fork each other’s work;
  • the audio engine, Studio and its AI agent, and other creation, playback, analysis and learning tools, whether they run in a browser, a desktop or standalone application, a plugin inside other software, or on hardware;
  • AI-assisted generation, transformation and analysis features for code, audio, MIDI and text;
  • software development kits, command-line tools, application programming interfaces, access tokens, agent and editor integrations, embeds, and hardware build, firmware and flashing tools;
  • the store and its products (including plugins, instruments, effects, sound banks, samples, presets, racks, courses and other digital goods, and any physical goods), whether free, paid, pre-ordered or offered as a trial;
  • creator, collaboration and selling programs, applications and briefs, newsletters, events, and support.

Maru is a platform. We provide tools; you decide what to make, upload, publish and share with them, and you are responsible for those decisions. We do not review content before it is uploaded or published, and we are not a party to any arrangement between you and other users.

Preview tools, prototypes, experiments, betas and unreleased features are under active development. Unless we expressly state otherwise, those preview surfaces are provided for research and evaluation only and are not intended for production, safety-critical, or mission-critical use.

2. How these terms fit together

Some parts of the Service come with additional terms: a product license, an end-user license agreement, a creator or collaboration agreement, program rules, or terms shown at the point of use (together, “additional terms”). Additional terms supplement these terms. If they conflict, the additional terms control for that product or feature only. Our Privacy Policy explains how we handle personal information and forms part of this agreement.

The terms of sale for products, including refunds, are in sections 16 to 18 of this page. There is no separate refund policy.

3. Your account

You must be at least 13 years old to hold an account, or older where your local law sets a higher minimum age for consenting to an online service on your own behalf. If you are under that age, do not create an account. To buy a product you must be old enough to enter into a binding contract where you live, or have a parent or guardian do so for you.

You are responsible for all activity under your account, including activity carried out by the Studio agent on your instructions (section 8), by tools or scripts using access tokens you create, and by integrations you connect. Keep your sign-in credentials, license keys and tokens secure, and tell us promptly if you believe someone else has used them. Give us accurate information and keep your email address current; we use it for receipts, license records and important notices.

4. Your content, and the license you grant us

You keep ownership of what you make. Projects, source code, presets, racks, sound banks, sounds and samples you upload, MIDI, descriptions, artwork, comments, prompts and agent conversations (together, “your content”) remain yours. These terms do not transfer ownership of your content to us.

To run and improve the Service we need permission to handle your content. You therefore grant Maru a worldwide, non-exclusive, royalty-free, fully paid, transferable and sublicensable license to host, store, cache, reproduce, analyze, adapt for technical purposes (for example transcoding, compiling, packaging, building or previewing your project), publicly display, publicly perform and distribute your content; to send it to the service providers that process it on our behalf, including AI model providers (section 8); and to let other users of the Service play, audition, embed, download where the surface offers it, and fork your content where you have made it public or unlisted.

This license also lets us use your content (whether public or private, and including your prompts, agent conversations and AI output) to operate, secure, develop and improve the Service and to build new features and products, including to train, evaluate and improve machine-learning models. It does not let us sell your content itself as a standalone product; selling your work through the store is governed by section 19.

The license ends for each item when you delete it, except for forks and copies others already made (section 6), content the Service needs to keep other users’ work functioning, de-identified or aggregated data, models and improvements already developed, and copies we keep under section 15.

What you promise about your content

You alone are responsible for the content you upload, generate, publish or ask the agent to create. By uploading or publishing content you confirm that:

  • you own it, or you hold every license, permission and clearance needed to upload it and to grant the license above, including for any samples, recordings, performances, compositions, presets, models, artwork and third-party or open-source code it contains;
  • its use through the Service, as described in these terms, does not infringe or misappropriate anyone’s copyright, neighbouring rights, trademark, patent, trade secret, privacy, publicity or other rights, and does not breach any contract, label, publishing or distribution agreement you are bound by;
  • any license you choose to attach to your work is one you are entitled to grant; and
  • to the extent the law allows, you waive (or have obtained a waiver of) any moral rights that would prevent the technical handling described above, such as transcoding, excerpting for previews, or displaying a fork without your name.

We do not verify ownership, licenses or clearances, and we accept no responsibility for checking them. If a claim is made against us because of content you uploaded, section 24 (indemnity) applies.

5. Public by default, and what public means

New modules you create in Studio are created as public. You can change a project’s visibility at any time from the Share control, which offers three settings: private (only you), unlisted (anyone with the link) and public (anyone, and listed on your profile). The Studio agent can also change visibility when you ask it to, or when doing so is part of carrying out your request (section 8).

When a project is public or unlisted, anyone who can open it can:

  • play and audition it in the browser;
  • read its latest saved source: the current revision, not your edit history;
  • fork it into their own account (see section 6); and
  • embed it on another website.

Your unsaved edits, your original brief, your agent conversations, your private projects and your revision history are not shown to other users. Publishing is your decision and you can reverse it for the future, but you cannot un-see what was already public: assume that anything you published may have been copied, forked or archived by someone while it was available.

6. Forks (the fork rule)

A fork is a new project in the forker’s own account, created from the source your project made available at the moment of the fork. A fork is an independent work from then on. It is owned and controlled by the person who made it, not by you and not by us. Whatever license you attached to your work continues to govern what the forker may do with your part of it; enforcing that license is between you and them.

Because of that, forks survive. If you later make your project private, archive it, or delete your account, forks that were already taken from it remain in their owners’ accounts, stay reachable at their own addresses, and keep the content they were made from.

What deletion does remove is the attribution: once your account is gone, the fork’s lineage no longer resolves to a public parent and the fork is shown without a named original. If you need a fork of your work taken down rather than merely unattributed, that is a request under section 13; write to us and say why.

7. What we cannot protect your work from

We will make reasonable efforts to respect your rights and to act on credible reports about them (section 13). But the Service exists to let audio, code and ideas be played, read, shared and reused, and you should understand the limits of what any platform like it can do:

  • Anything that plays in a browser can be captured. Audio can be recorded or resampled; module source, compiled code, presets and samples delivered to a visitor’s browser or device can be saved, inspected, decompiled, reverse-engineered or re-implemented. We do not provide copy protection or digital rights management for your content.
  • Other people may use your work in ways you did not intend: playing your instruments or effects in their own music, building on your code, imitating your sound or design, or using it outside the Service, whether or not that respects the license you chose.
  • Ideas are not protected by us. Concepts, techniques, workflows, prompts, briefs, product ideas and feedback are not treated as confidential, and we owe no duty of confidentiality for them. We, other users and AI systems may independently create things that are similar to yours, and similarity alone is not a breach of these terms.
  • Private does not mean secret. Private projects are not shown to other users, but they are still stored on our infrastructure, processed by our service providers, and may be used to improve the Service as described in section 4 (see the Privacy Policy). Do not upload anything whose disclosure would cause you serious harm.

We are not responsible for, and have no obligation to prevent, monitor or enforce your rights against, any copying, sampling, reverse engineering, imitation or other use of your content by other users or third parties, whether or not it happens on the Service and whether or not it infringes your rights. Any claim you have about such use is against the person who did it, not against us. We may, at our discretion, remove content or suspend accounts in response to a credible report, but choosing not to act, or acting without success, does not make us liable.

8. The Studio agent and AI features

Maru includes an AI agent in Studio and other features that use machine-learning models to generate, transform or analyze code, audio and MIDI (together, “AI features”). These are preview features and they make mistakes.

The agent acts on your behalf

When you instruct the agent, you authorize it to act in your account as you. Depending on what you ask, it may: create projects and sound banks; read, write and replace module source code; edit presets, racks, sampler banks and clip metadata; generate, slice and save audio and MIDI; search the web where you have enabled that; and change the visibility of your work, including making it public. Most of these actions are applied directly, without asking you to confirm each step.

Actions the agent takes on your instructions are treated as actions you took. The agent may misunderstand a request, take more or different steps than you expected, overwrite or break working code, produce output that does not do what it says, or publish something you meant to keep private. You are responsible for reviewing what it did before you rely on it, publish it, share it or distribute it. Revision history may let you roll back a change, but we do not guarantee that any change can be undone.

Do not instruct the agent to do anything you could not lawfully or permissibly do yourself under these terms, and do not feed it content designed to make it act against these terms or against other users (for example, instructions hidden in uploaded files or web pages).

AI output

Code, audio, MIDI, text and other material produced by AI features (“output”) may be inaccurate, insecure, incomplete, unsuitable for your purpose, or similar or identical to output produced for other people. As between you and us, and to the extent any rights exist in it, output you generate belongs to you, under the same terms as your content. We do not warrant that output is original, that it is protectable by copyright, or that using it will not infringe anyone’s rights. Some generation models are made available under their own licenses, which may limit how their output can be used; where a surface identifies such a limit, it applies to you. You are responsible for checking output, and for clearing any rights it needs, before you publish, sell or otherwise use it.

Model providers

To answer you, AI features send your messages, conversation history, attached images and audio where a feature needs them, and the project context they need (such as source code) to third-party AI model and inference providers, which process it under their own terms. The Privacy Policy names them and describes what is sent. Do not include confidential information, personal information about others, or secrets such as passwords or API keys in prompts or attachments.

We may limit, queue, throttle or withdraw AI features, change the models and providers behind them, and set usage limits, credits or quotas at any time. AI features are currently provided without separate charge; that is not a commitment that they will remain free.

9. Third-party services and keys you bring

Some features connect to services we do not operate, for example signing in with Google or GitHub, installing our GitHub App to read your repositories, using a paid stem-separation provider with your own API key, or loading our products in a host application such as a digital audio workstation. When you connect or use such a service you do so under that provider’s terms, you are responsible for any charges it bills you (including for jobs you cancel), and we are not responsible for its availability, its handling of your data, its compatibility with our products, or its output. API keys you bring for such providers are stored in your browser, not by us; keeping them secure is your responsibility.

The Service may link to websites, content and offers of others. We do not control them and are not responsible for them.

10. Developer tools, APIs and integrations

SDKs, command-line tools, APIs, access tokens, agent and editor integrations, embeds and example code are provided to help you build with Maru. Unless an additional term says otherwise, they may change, break compatibility, or be rate-limited or withdrawn at any time; we may revoke a token or integration that is abused or puts the Service at risk. Code we publish under an open-source license is governed by that license for the code itself; these terms still govern your use of our hosted Service.

11. Code from other users, sound and equipment

Community modules are written by other users and, where we have not said otherwise, are not reviewed by us. They run in your browser in a restricted environment we designed to limit what they can do, but no sandbox is perfect. Use other people’s modules, presets and code at your own risk.

Audio software can produce sudden, very loud sound. A bug, an extreme parameter, a feedback loop or a malicious module can damage hearing, speakers, headphones and other equipment. Keep levels low when trying anything new and use a limiter. Features that send MIDI or other signals to connected devices may change their state or settings. Hardware build, flashing and installation tools are provided for local use and run at your own risk; flashing firmware or modifying a device can make it unusable and may void its warranty.

To the extent the law allows, we are not liable for hearing damage, damage to equipment or devices, or loss of data caused by modules, presets, code, products or output you choose to run, whether written by you, another user, us or the agent.

12. Acceptable use

By using the Service you agree that you will:

  • Use each part of the Service under its applicable access terms or product license. Preview tools and prototypes remain for research and evaluation unless we expressly state otherwise.
  • Comply with all applicable laws and not use the Service, or the agent, to create, distribute, or facilitate anything unlawful, infringing, harmful, deceptive or abusive.
  • Not publish content you do not have the rights to, including samples, recordings or code under a license that forbids it.
  • Not upload or publish malware, or modules designed to harm listeners, their equipment, their data, or the Service, and not attempt to escape the module sandbox.
  • Not attempt to disrupt, overload, reverse-engineer for circumvention, or gain unauthorized access to the Service or the systems and accounts of others, or to circumvent usage limits, license checks, activation or other technical measures that protect products.
  • Not copy, share, resell, rent, sublicense or otherwise distribute our products, license keys or downloads except as their license allows.
  • Not scrape or bulk-download other users’ content or our products, or use them to train machine-learning models, except as their license and these terms permit.
  • Not impersonate others, or misrepresent AI output as a human performance where that would mislead people.
  • Take responsibility for the content you submit and for any output you choose to use, publish, or distribute.

For guidance on discussions, feedback, remixes and contributions, see our Code of Conduct.

13. Reporting and takedown

If you believe something published on Maru infringes your rights, breaks these terms, or should not be there, write to hello@maruaudio.com. Tell us what you are reporting (a link is best), what rights you hold, and why. Community module pages also carry a Report link that opens a message to the same address with the page URL already filled in. A human reads it. If your content is removed and you believe that was a mistake, write to the same address and explain why.

We may remove first and discuss after. Where a report looks credible we may hide or remove content, and suspend or terminate an account, before the matter is resolved, and we may do so without prior notice. We terminate the accounts of repeat infringers where appropriate. We have no general obligation to monitor content, and we are a small team that does not promise a response time; what we do promise is that the address above is read.

14. Suspension, termination and changes to the Service

We may suspend or terminate your access, or remove any content, at any time, with or without notice, if we believe these terms are being violated, if it is needed to protect the Service or its users, or if we are required to. You may stop using the Service at any time. You can remove your creator data in account settings, or write to us to request deletion of your sign-in account as well. If we terminate your account because you breached these terms, licenses attached to it may end too (section 16).

The Service is under active development. We may add, change, restrict or remove features, limits, quotas, storage allowances, AI models, surfaces and products, and we may do so without notice. A limit that is generous today is not a commitment.

15. Deletion, and what we keep

When you delete your account, we delete or de-identify the personal information associated with it and remove your projects and profile from the Service within a reasonable period, as described in the Privacy Policy. Some content and records remain: forks and copies others already made (section 6); files, links and references the Service needs to keep other users’ work functioning, kept without your name; de-identified and aggregated data, and improvements and models already developed using your content; backups and logs until they expire; and records we must or may keep for legal, tax, accounting, security, enforcement or dispute-resolution reasons, including order and license records. Deleting your account also removes access to products in your library; download what you want to keep first.

16. Products and product licenses

Products are licensed, not sold. When you acquire a product (free or paid), you receive a license to use it under the product license presented on its page, in its acquisition flow, or with your order, and under these terms. We (or the creator who made it) keep all ownership of the product itself. The license recorded with your order is the record of the terms presented at acquisition. If a product license conflicts with these terms, the product license controls for that product only. Acquiring a product does not grant rights to unrelated preview tools, source code, SDKs, online services, or future products unless the product license expressly includes them.

Unless the product license says otherwise:

  • The license is personal. It is attached to the account you acquired the product with, for your own use or your organization’s internal use by the licensed person. You may install it on the computers you personally use, within any limit the product states.
  • No resale or transfer. You may not sell, rent, lend, share, sublicense or transfer the product, its license or its license keys to anyone else, except where we agree in writing or the law requires otherwise.
  • What you make is yours. Music, recordings and other work you create using a product are yours, and you may use and sell them royalty-free. You may not redistribute the product’s own content (its samples, presets, sound banks, impulse responses or code) on its own or as part of another sample library, preset pack, instrument or competing product.
  • No reverse engineering of products, and no circumvention of their license checks, except to the extent the law gives you a right to do so that cannot be waived.
  • Activation and license checks. Some products use license keys, sign-in, online activation or periodic checks to confirm the license. You are responsible for keeping your keys private. Keys that are shared, leaked or obtained through fraud or a reversed payment may be deactivated.

Maru sample-pack audio license

Version 2026-10-20.1. This product license applies to the audio files supplied in sample-pack downloads and controls over the general product permissions above for that audio.

  • You may not use this audio for machine learning, model training, or fine-tuning.
  • You may not remix this audio outside the Maru platform.
  • You may not redistribute this audio in any form.

This license text may be updated in future versions. Keep this copy as the license version supplied with your download.

The downloaded ZIP includes a copy in LICENSE.txt.

Plug-in activation. Maru plug-ins that use our license service work like this, unless the product page says otherwise:

  • Up to 3 computers. You activate a computer by signing in from the plug-in and approving it in your browser. Each license can be active on up to 3 computers at a time. You can remove a computer from the plug-in or from Plug-in activations in your account to free its place.
  • Online check at least every 30 days. The plug-in confirms the license with our servers in the background. It keeps working offline, warns you after 16 days without a check, and stops processing after 30 days until it can check again.
  • What an inactive license does. When a plug-in is not activated, its trial has ended, or its license has ended, an effect passes your audio through unchanged instead of processing it, so your projects keep playing.
  • Trials. Each account gets one trial per plug-in, 14 days long unless the product says otherwise, on the same computer limit. Buying during the trial converts the activation.
  • Refunds and reversed payments end the license. Activated computers stop at their next check.
  • Copying a license file to another computer, tampering with activation, or sharing a license beyond its limit is not permitted, and activations that do so may be removed.

Trials, demos and free products. Some products offer a trial or demo, which may be time-limited or restricted. A trial lets you check that a product works on your system and suits you before you buy it, and we encourage you to use it. Free products and trials are provided without warranty, and we may change or end them at any time.

System requirements and compatibility. Each product lists the operating systems, plugin formats, host applications and hardware it supports. It is your responsibility to check them, and to try the trial where one exists, before buying. We do not guarantee that a product will work with systems, hosts or versions it does not list, or that it will remain compatible with future operating systems, host applications or hardware, though we try.

Updates and versions. When the store describes a product as having a perpetual license, that means a one-time acquisition and continued use of the major version acquired, without a subscription. Updates within that major version may be provided free of charge at our discretion. Future major versions, upgrades, online services and other products may be offered separately and for a fee. We may stop selling, updating or supporting a product at any time; doing so does not end a license you already hold for the version you have, but online features it depends on may stop working.

Physical goods. If we sell hardware, kits or other physical goods, the shipping, delivery, warranty and return terms shown with that product or order apply in addition to these terms.

When a license ends. A license ends if the purchase is refunded or the payment is reversed (section 18), or if you seriously or repeatedly breach its terms or these terms. When it ends, the product leaves your library and you must stop using it and delete your copies. Work you created with the product while you held the license remains yours.

17. Purchases, pricing and payment

Maru is the seller of every product sold on Maru, including any product made by another creator and sold through the store. When you place an order you make an offer to buy; your purchase is confirmed when payment succeeds, and the product license is then attached to the account you bought it with. Delivery is electronic: access in your library, a download, or a license key.

  • Prices and currency. Prices are shown in US dollars unless the store says otherwise. Your bank may apply its own currency conversion and foreign-transaction fees, which are outside our control.
  • Taxes. Where we are required to collect sales tax, VAT, GST/HST, QST or similar taxes, they are added and shown at checkout before you pay.
  • Payment. Payment is processed by our payment providers; we do not store your complete card number. You confirm that you are authorized to use the payment method you provide.
  • Price changes and promotions. We may change prices, run promotions and offer discount codes at any time. A price change or later promotion does not entitle you to a refund or price adjustment on an earlier purchase. Discount codes have no cash value and may carry their own conditions.
  • Errors and refusals. If a product is listed at an obviously wrong price or with wrong information, or an order looks fraudulent, we may refuse or cancel the order and refund any amount paid.
  • Pre-orders. A pre-order reserves a product that is not yet fully released. Release dates are estimates and may change. Where a pre-order includes early or preview access, that access is a preview under section 1.

18. Refunds

To ask for a refund, contact us at hello@maruaudio.com within 30 days of your purchase (or, for a pre-order, within 30 days of the product’s full release). Write from the email address on your account and include your order number (it is on your receipt and in your library). We review each request and will work with you on a fix, a credit or a refund. Refunds go back to the original payment method.

Products are delivered digitally and can be used immediately, and many of them can be tried before you buy, so after 30 days purchases are final, except where the law requires otherwise. At checkout you ask us to make the product available immediately and acknowledge that, where the law gives a cancellation right for digital content (for example in the European Union or the United Kingdom), that right ends once the download or access begins.

A refund, or a payment reversed through your bank, ends the license for the refunded product (section 16). Please contact us before disputing a charge with your bank; while a dispute is open the licenses from that order may be suspended. We may decline refund requests that look abusive, and close accounts involved in fraud or in disputes filed in bad faith.

Nothing in this section limits rights you have under the consumer protection laws where you live, including the right to a remedy for a product that is defective or not as described.

19. Selling and collaborating through Maru

Creators may sell or distribute their work through Maru, and people may apply to collaborate with us, under a separate creator, collaboration or distribution agreement. That agreement governs revenue shares, payouts, exclusivity and the rights you grant for the product; these terms govern everything else. Because Maru is the seller of record, we set store policies, including prices, promotions, taxes and refunds, as that agreement allows. You are responsible for your own taxes on what you earn. Submitting an application, brief or proposal does not create an agreement or an obligation to work with you.

20. Our intellectual property

Apart from your content and content published by other users, the Service and everything in it (including the engine, software, products, models, sounds, designs, text, graphics, documentation and the Maru name and logos) belong to us or our licensors and are protected by intellectual property laws. These terms grant you only the rights they expressly state. Open-source components are licensed under their own licenses. You may not use our names or logos in a way that suggests endorsement without our written permission.

21. Feedback

If you send us suggestions, ideas or feedback, we may use them freely, without obligation or payment to you. Feedback is not your content for the purposes of section 4 and is not confidential.

22. No warranty

Except where a product license expressly states otherwise, the Service and all products are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service or any product will be uninterrupted, secure, error-free or compatible with your system, that the agent will carry out your instructions correctly, or that any output will be accurate, complete, original, non-infringing or suitable for any purpose. Preview features may break, preview data may be lost, and their behavior may change without notice. Content published by other users is theirs, not ours, and we do not warrant it.

Keep your own copy. Do not treat Maru as the only place your work, or your downloads and license keys, exist.

23. Limitation of liability

To the maximum extent permitted by law, in no event will Maru, its maintainers, contributors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to:

  • your access to, use of, inability to use, or misuse of the Service or any product;
  • actions taken by the agent or by AI features on your instructions, and any output they produce;
  • content published by other users, including modules you choose to run;
  • any copying, sampling, reverse engineering, imitation or other use of your content by other users or third parties (section 7);
  • third-party services you connect or use (section 9); or
  • the access or misuse of the Service by anyone using your account, your tokens or your license keys,

whether based in contract, tort (including negligence), strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service and products is limited to the greater of the amount you paid us in the twelve months before the claim (if any) or US$100.

Some jurisdictions, including the Province of Quebec, do not allow the exclusion of certain warranties or the limitation of certain damages for consumers. Where that is the case, the exclusions and limits above apply only to the fullest extent those laws permit, and nothing in these terms limits liability that cannot lawfully be limited, or rights you have as a consumer that cannot be waived by contract.

24. Your responsibility and indemnity

You agree to indemnify, defend and hold harmless Maru and its maintainers, contributors and affiliates from any claims, damages, liabilities, losses and expenses (including reasonable legal fees) arising out of or relating to: your content and its publication; output you generate and choose to use, publish or distribute; actions the agent takes on your instructions; your use or misuse of the Service or any product; your violation of these terms or a product license; or your violation of any law or of anyone else’s rights. This section applies to consumers only to the extent the law where they live allows.

25. Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to its conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute arising from them, except where mandatory local law gives you the right to bring proceedings elsewhere or to the benefit of its consumer protection rules. Before starting any proceeding, please write to us so we can try to resolve the issue informally.

26. Not affiliated with similarly named companies

Maru is an independent project. It is not affiliated with, endorsed by, or connected to any other company, product, or service that may share a similar name. Any resemblance in name is coincidental. Product names, trademarks and brands of others mentioned on the Service, including host applications and hardware we support or that inspired a sound or design, belong to their respective owners and are used only to identify or describe; their mention does not imply endorsement.

27. Communications

You agree that we may communicate with you electronically, by email or through the Service, about your account, orders, receipts, licenses, security and changes to these terms, and that those communications satisfy any legal requirement that they be in writing. Marketing emails, such as the newsletter, are sent only if you sign up, and you can unsubscribe at any time.

28. General

These terms, together with the Privacy Policy and any additional terms that apply to you, are the whole agreement between you and us about the Service. If any part of them is found unenforceable, the rest remains in effect and the unenforceable part is applied to the fullest extent allowed. Our not enforcing a term is not a waiver of it. You may not transfer these terms, your account or your licenses without our consent; we may transfer them as part of a reorganization, merger or sale of the Service. We are not responsible for failures caused by events beyond our reasonable control, including outages of the providers we rely on.

You may not use, export or re-export the Service or products in breach of export-control or sanctions laws, or if you are subject to such sanctions.

These terms are written in English and the parties have agreed that they, and all related documents, be drawn up in English. Les parties ont convenu que ces conditions et tous les documents qui s’y rattachent soient rédigés en anglais. Where the law where you live requires a version in another language, we will make one available, and it will have equal value.

Sections that by their nature should survive termination (including 4 (for forks and existing copies), 6, 7, 15, 16 (for licenses already granted), 18, 20 to 25 and this section) survive it.

29. Changes to these terms

We may update these terms from time to time, for example as we add features and products. When we do, we will revise the version and date above, and we will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms. The terms of sale in force when you bought a product apply to that purchase, unless a later version is more favourable to you.

30. Contact
